ARTICLE 1 – GENERAL
The buyer acknowledges having read these General Terms and Conditions (GTC) before placing the order. The general terms of sale apply exclusively to all sales concluded for our products, owned by the company JOLT LAB LLP, both for its own account and on behalf of its principals. Any other conditions shall only bind the seller after written confirmation from them. The mere act of placing an order or accepting an offer from the seller implies unconditional acceptance of these general conditions. Any condition that does not conform to our general conditions that the buyer has formulated will be rejected unless we have expressly and in writing recognized its applicability. These general conditions may be modified at any time and without notice by the company JOLT LAB LLP, with the modifications then applicable to all subsequent orders.
ARTICLE 2 – ORDERS
Orders are effective from the date of receipt of payment. The customer can be refunded if they wish, under the conditions of article L 121-20-1. The company JOLT LAB LLP commits to delivering to the buyer as soon as possible. The buyer will be delivered according to the timelines mentioned on the website www.getjolt.fr except in exceptional cases (postal strike, extraordinary events, etc.). However, the delivery times may be longer (for example, during certain times of the year such as the Christmas holiday period), which the buyer understands and accepts.
ARTICLE 3 – PRICE
The list of seller prices does not constitute a sale. It can be modified unilaterally without prior information before purchase by the customer. The goods are invoiced at the agreed price within the limit of the option period and the general economic conditions (taxes, exchange rates, etc.), at the time of delivery. All prices indicated on the seller's website are net in euros, all taxes included, excluding transport costs, which will be indicated before the order is registered by the buyer. Prices may be subject to promotions, sales, and other price reductions.
ARTICLE 4 – PAYMENT
All orders are payable in Euros. The full payment of the price must be made at the time of ordering by the buyer. At no time can the amounts paid be considered as deposits or down payments. To pay for their order, the buyer must have a credit card or a Paypal account. Payment by card or Paypal is fully secured by Secure Socket Layer (SSL) protocol. The encryption is done in such a way that no one can access the data for dishonest purposes. The order will be shipped as soon as payment is confirmed. The buyer guarantees to the company JOLT LAB LLP that they have any necessary authorizations to use the chosen payment method when registering the purchase order. The company JOLT LAB LLP reserves the right to suspend or cancel any order and/or delivery, regardless of their nature and level of execution, in case of non-payment of any amount due by the buyer or in case of a payment incident. The company JOLT LAB LLP reserves the right to request a photocopy of the buyer's identity card and/or proof of address for any order. As part of the fight against online fraud, information related to your order may be checked for verification.
ARTICLE 5 – CHOICE OF ARTICLES
The buyer, having taken note of the products and their characteristics marketed by the company JOLT LAB LLP has, under its sole responsibility and based on its needs as previously determined before any order, made its choice regarding the product(s) that are the subject of its order. In case of unavailability, and without calling into question what is stated in Article 2, JOLT™ may provide a good or service of equivalent quality and price.
ARTICLE 6 – WARRANTY
All products sold by JOLT™ are subject to warranty. This warranty applies only to products sold by JOLT™. This warranty is effective within the framework of product use in accordance with the corresponding recommendations and instruction manuals. Warranty durations are specified on the product sheets of the website www.getjolt.fr.
In any case, the products are guaranteed for 2 years for parts and labor.
Reasons for exclusion of the guarantee :
• intentional damage: damage intentionally inflicted on the product
• misuse, contrary to the recommendations or the instruction manual
• Failure to comply with safety instructions
• Cosmetic damage
In case of a breakdown or damage covered by the warranty and not repairable, JOLT™ commits to replacing the part or product with a new one if the part cannot be changed or repaired.
ARTICLE 7 – DELIVERY
Delivery time : All our products are in stock in our warehouse in France (we are not “dropshippers”: we are the owners and creators of our products, our brand and our supply chain). Your order is shipped within 2 working days maximum from our logistics center, unless otherwise stated on the product sheet or when finalizing the order. From this moment, you will receive a tracking number from our service provider (Colissimo or DPD) to be able to locate your package. Delivery is then generally made within 48/72 working hours maximum.
General rules: The products will be delivered to the address indicated by the buyer on the purchase order. In the event of absence, a delivery notice will be left in your mailbox, you will then be able toreschedule a delivery or collect the products ordered from an establishment of your choice, during the deadline indicated by the carrier on the delivery notice.
Delivery issues : The buyer is required to check, in the presence of the carrier in charge, the condition of the packaging of the goods, its contents and its functioning upon delivery. In the event that the buyer has any doubt of any nature whatsoever, he is required: To apply the return procedure (in particular to report the damage due, any complaints and reservations) and to refuse the goods by immediately issuing a report of an anomaly to the delivery person in charge. It is necessary to report these incidents within 3 days from the refusal of the goods by the buyer, stating the said complaints or reservations.
Quality or compliance issues : In the event of delivery of a product that does not correspond to the order (defective or non-compliant), the buyer must make their complaint within 5 days of signing the delivery slip. Complaints must be sent using the contact form and must include: The buyer's contact details, the order number concerned, the product references, the reasons for the complaint. The return procedure will then be communicated to you. Products returned by the buyer must be returned within a maximum of 15 working days from the date of delivery, or the date of return authorization.
ARTICLE 8 – RESERVATION OF OWNERSHIP
In accordance with the law, the transfer of ownership of the goods delivered to the buyer will only take place after full payment of the price in principal and accessory or the cashing of accepted checks or other means of payment issued for the purpose of settlement of the price. During the period from delivery to transfer of ownership, the risks of loss, theft or destruction are the responsibility of the buyer. Failure by the buyer to fulfill his payment obligations, for whatever reason, gives the seller the right to demand the immediate return of the goods delivered at the expense and risk of the buyer.
ARTICLE 9 – RIGHT OF WITHDRAWAL & RETURNS
Right to retract :
The French buyer legally has a right of withdrawal of 14 days from the day after the day on which he comes into possession of the product. He will be liable for return costs. This right of withdrawal also applies to sale products sold on www.getjolt.fr.
The refund will be made within 14 days from the moment JOLT™ receives the returned product. The buyer must have informed JOLT™ in advance of their decision to withdraw. This decision must be notified by the customer through the contact form. JOLT™ will inspect the returned product to validate its good condition.
ARTICLE 10 – MANIFEST ERROR IN PRICE :
The merchant reserves the right to cancel any order in the event of a manifest pricing error. This clause can be invoked if an incorrect price has been displayed on the site, even after confirmation of the order, as long as it has not been shipped. In the event of cancellation, the customer will be informed by email as soon as possible.
Returns :
Please refer to the warranty exclusions developed in article 6. The buyer must return the product in its original packaging, unused, with all its accessories, indicating the reason on the invoice.
The buyer can then choose different options:
• a new delivery respecting the order
• repair of the defective product
• the exchange of the product with another similar one
• cancellation of the order.
